Estate Planning
Estate planning can seem obscure and easily to procrastinate, we want to encourage you to think of these components as Tools for anybody that wants to be a responsible Steward in the affairs of their House.
Key Components:
- Last Will and Testament: Directs asset distribution, appoints guardians for minors, and names an executor to manage the estate. Everybody should have a Will!
- Trusts (Revocable or Irrevocable): Allow for control over assets during life, avoid probate, and set specific conditions for how beneficiaries receive assets. A “pour-over will” directs any assets not in the trust into the trust at death.
- Durable Power of Attorney (DPOA): Appoints a trusted person to manage financial affairs if you become incapacitated, handling everything outside of a Trust, ensuring continuity of management.
- Living Will/Medical POA: Designates someone to make medical decisions if you cannot communicate, often paired with a living will that outlines specific treatment preferences.
- Beneficiary Designations: Directs all accounts, IRAs, 401(k)s and 403(b)s to beneficiaries, overriding wills. These must be kept up-to-date.
- Letter of Intent: A non-legally binding document providing instructions to executors or family members, such as funeral preferences or personal notes.
- Guardianship Designation: Specifically names who will care for minor children.
